Navien, Inc., a california corporation provides you with this Privacy Policy to inform you how Company collects, uses, protects, discloses, transfers, and stores your information, and to otherwise disclose the privacy practices employed in connection with your use of the Navien Sleep Plus Application and Service.  Unless otherwise stated herein, this Privacy Policy applies solely to information that is collected and used in connection with the Navien Sleep Plus Application.

Please read this Privacy Policy carefully.  By accessing or using the Navien Sleep Plus Application, the Service and/or the Product (as defined below), or Company products in connection therewith, you acknowledge that you have read and agreed to the provisions of this Privacy Policy, and consent to the collection and use of your personal information and other information as described herein.

Your right to use the Navien Sleep Plus Apllication and Services are subject to the disclosures, terms and conditions set forth in Privacy Policy. If you disagree with any of the disclosures, terms or conditions set forth in the Privacy Policy, then you are not authorized to use the Navien Sleep Plus Application and/or the Services in any manner, and you agree to not use ths Navien Sleep Plus Application and/or Services.


DEFINITIONS 

Terms used in this Privacy Policy shall be defined as set forth below.  Terms not defined hereunder shall be construed in accordance with applicable laws or regulations, or as otherwise defined by Company.

1. "Agreement" means the End User License and agreement between the Company and you for the use of Navien Sleep Plus Application and Services.

2. "Navien Sleep Plus Apllication" means the software application to be installed in mobile telecommunication including smartphone of User Customer for using the Service.

3. "Company" means Navien, Inc., a califronia corporation.

4. “Product” means the series of bed warming mattress pads of Navien Mate which are purchased from the Company and used by the user customers. 

5. “Service” or “Services” means the Navien Sleep Plus Remote Control Service and all the additional services related thereto which provides the functions including remote control by interlocking the Product installed in the house of User Customer with Navien applications.

6. “User Customer” means the person using the Product of Company who joins this application account and provides his/her personal information to the Company and use the Service provided by Company hereunder.

7. “Your” or “your” means the end user who will have access to and use the Navien Sleep Plus Application in conjunction with the Product.


COLLECTION OF INFORMATION

Upon registration and log-in through the Navien Sleep Plus Application, and during your use of the Navien Sleep Plus Application and/or Services, the Company may collect, use, process, and store certain personal information, diagnostic, usage, and other related content or data from the devices which you use to access the Services.

The Company respects your privacy, and any such information shall be subject to our Privacy Policy.

The Company collects information you provide to us which may include your name, email address and telephone number.

We collect this information in a number of ways, including when you enter it while using our Service, interact with our customer service, or participate in surveys or marketing promotions; and information collected when you choose to provide reviews or ratings, set preferences in your account or otherwise provide information to us through our Services or elsewhere.

We may also collect information regarding you and your interactions with us and our advertising, your use of our Services, applications, sites, tools, and customer service, as well as information regarding your computer or other device used to access our Service (such as gaming systems, smart TVs, mobile devices, and set top boxes).

This information may include: your activity on the Navien Sleep Plus Application, details regarding your interactions with customer service, such as the date, time and reason for contacting us, transcripts of any chat conversations, and if you call us, your phone number; device IDs or unique identifiers, device and software characteristics (such as type and configuration), connection information, statistics on page views, referral URLs, ad data, IP address and standard web log information; information collected via the use of cookies, web beacons and other technologies. 

USE OF INFORMATION

We use the information we collect to provide, analyze, administer, enhance and personalize our Services and marketing efforts for you and others.

For example, we may use the information we collect for purposes such as: helping us quickly and efficiently respond to inquiries and requests; preventing, detecting and investigating potentially prohibited or illegal activities, including fraud, and enforcing our terms; sending you e-mails, push notifications or other correspondence and advertising concerning our Service, including newsletters, messages about new Products or features, special offers, promotional announcements and consumer surveys.

From time to time, we may partner with companies whose products we believe will interest our members.

We may share your information with the following companies and/or in the following manner:

(a) Among our affiliated companies. These companies, when handling this information, will follow practices that are consistent with the practices described in this Privacy Policy.

(b) Among our service providers. We may use other companies, agents or contractors to perform Services on our behalf or to assist us with the provision of Services to you. For example, we may engage service providers to provide marketing, advertising, communications, infrastructure and IT services, to personalize and optimize our Service and to process and administer consumer surveys. (c) We may offer joint promotions or programs that, in order for your participation, will require us to share your information with third parties. In fulfilling these types of promotions, we may share your name and other information in connection with fulfilling the incentive. (f) If you share or otherwise allow others to have access to your account, they will be able to see your information, including in some cases personal information such as your usage history, preferences, reviews and account information (including your email address or other information in your account).

(g) We may provide analysis of and information from or about our User Customers in the aggregate or otherwise in anonymous form to partners, service providers and other third parties.

By using our Services, you acknowledge and agree to the transfer of your information outside your country of residence to any country (including the United States) where the Company may have facilities or engage service providers.

You understand that the countries to which we may transfer information may not have as comprehensive a level of data protection as in your country, although your personal information will continue to be protected in accordance with the standards described in this policy.

OPTING OUT

If you no longer want to receive certain communications from us via email, SMS or mail, please contact the Company in writing or by calling customer service to submit you opt-out request.

Alternatively, you may contact the Company in writing or by calling customer services to submit you opt out request.

If you decide you no longer wish to receive any push notifications, you can use your mobile device’s settings functionality to turn them off.

SECURITY

We use reasonable administrative, technical, physical and managerial measures to safeguard your personal information against loss, theft and unauthorized access, use and modification.

However, no security system can be guaranteed to be fully secure. Accordingly, we cannot guarantee the security of your information and cannot assume liability for improper access to it.

By using our Service, including the Navien Sleep Plus Application, or providing information to us through any means, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services.

You are responsible for maintaining the confidentiality of your account access information and for restricting access to your computer or mobile device through which you access the Services.

If you do not maintain the security of your password or device, or fail to log out or deactivate your device, subsequent users may be able to access your account, including your personal information.


DESTRUCTION OF PERSONAL INFORMATION

After achieving the purpose of collection and use of personal information and in cases where the retention of any personal information becomes unnecessary including cases where the period of retention and use expires or business is closed, the Company will dispose of the personal information.

The Company deletes personal information stored electronically through use of applicable technology which renders the personal information unusable, accessible or capable of regeneration.

The Company will destroy hard copies of personal information by shredding with a pulverizer or incinerating it.

This CCPA Privacy Policy for Navien Sleep Plus application service (“Policy”) supplements the information contained in Navien, Inc.’s Privacy Policy for Navien Sleep Plus Application Service and applies solely to all consumers and households who reside in the State of California (“consumers” or “you”). Navien, Inc. (“Navien” or “we”) adopts this Policy to comply with the California Consumer Privacy Act of 2018 (“CCPA”). Any terms defined in the CCPA have the same meaning when used in this Policy.


I. PERSONAL INFORMATION WE COLLECT

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). We has collected the following categories of personal information from its consumers within the last twelve (12) months:

• Category E: Biometric information. – Genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data. • Category F: Internet or other network activity – Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement. Collected - YES

• Category H: Sensory data – Audio, electronic, visual, thermal, olfactory, or similar information. Collected - NO

• Category I: Professional or employment-related information – Current or past job history or performance evaluations. Collected - NO

• Category J: Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99) – Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records. Collected - NO

• Category K: Inferences drawn from other personal information – Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. Collected – NO

Personal information does not include:

• Publicly available information from government records.

• Deidentified or aggregated consumer information.

• Information excluded from the CCPA’s scope, like:

◌ health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;

◌ personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

Navien obtains the foregoing categories of personal information from the following categories of dources:

• Directly from you. (i.e., from forms you complete or products and services you purchase)

• Indirectly from you. (i.e., from observing or logging your actions on our Website)

Ⅲ. PERSONAL INFORMATION SALES OPT-OUT AND OPT-IN RIGHTS AND OTHER CONSUMER REQUESTS

Navien does not sell, rent or trade any personal information to third parties. Nonetheless, if you are 16 years of age or older, you have the right to direct us not to sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we actually know are less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time.

To exercise the right to opt-out or to submit any other verifiable consumer request, you (or your authorized representative) may submit a request to us by calling 800-519-8794 or by completing the online form located at https://www.navieninc.com/contact.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by submitting a request to us at the web address above.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.
